The Madras High Court has treated as closed a petition by a person seeking a direction to the police to register and investigate a case based on an order of a Judicial Magistrate on a complaint against actor Kamal Haasan and others.
In his petition, S.Senthilkumar of West Tambaram said he was working as an Assistant Director in various films for the past several years.
In June 2005, he created a story in the name of Arthanari alias Kloning. He sent the story CD to the actor by registered post. Mr.Kamal Haasan promised to pay him Rs.25 lakh and also a chance to work as an Assistant Director in the film to be produced by the actor.
He alleged that his story was used for producing the film ‘Dasavatharam' without his knowledge.
He gave a complaint to the police, but no action was taken.
He filed a civil suit in the High Court against the actor and the application for injunction was dismissed. However, he was permitted to prosecute the suit and the same was still pending.
On September 2, 2007 a group of persons came to his residence and threatened him to withdraw the case. He gave a complaint to the city police dated September 5 to give protection to him and his family members, but no FIR was registered.
Hence, he filed a complaint with the Judicial Magistrate, Tambaram, who forwarded the complaint to the police. So far no action had been taken. Hence, the present petition.
When the matter came up before Justice R.Regupathi, the prosecution submitted that due to the formation of a new Commissionerate, i.e. Chennai Suburban Police Commissionerate, the task was shifted to the said unit. The Tambaram Inspector conducted an enquiry and examined the landlord of the premises where the petitioner resided and other witnesses and concluded that the allegations were baseless.
A report to this effect had been submitted to the Judicial Magistrate, Tambaram. Recording the submission, Mr.Justice Regupathi treated the petition as closed.
