Panel recommendations to be implemented after case disposal

The Tamil Nadu government on Wednesday informed the Supreme Court that Justice Sivasubramaniam Commission's recommendations regarding land grabbing in Siruthavur village would be implemented after the disposal of the case pending in the court.

Senior counsel T.R. Andhyarujina and Additional Advocate General P. Wilson submitted before a Bench of Justice P. Sathasivam and Justice B.S. Chauhan that the Commission's report was placed in the Assembly in May this year and the government was awaiting disposal of the case by the Supreme Court for implementing the report.

Considering the urgency involved in the issue, the Bench posted the appeal filed by T. Chitra and J. Ilavarasi, challenging a Madras High Court judgment upholding the setting up of the Commission, for final hearing in the third week of October.

In its report the Commission had said, “There is no material to suggest that former Chief Minister Jayalalithaa was involved in land grabbing in Siruthavur village.”

However, the Commission held Sudhakaran and Ilavarasi, both related to Ms.Jayalalithaa's close friend Sasikala, as beneficiaries of an “illegal transfer of patta on a single day without any inquiry.”

The report said that both were “guilty of manipulating the records” to extricate themselves from the enquiry.

“As far as Tmt.Sasikala was concerned, the assigned properties had not been acquired in her name and “it is also not shown that she is the partner of Bharani resorts, which had acquired the assigned properties.”

The Commission was set up to probe allegations of fraudulent grabbing of 53 acres of lands assigned to Scheduled Castes and landless poor in Siruthavur village.

In 1968, the State government had allotted the lands under the Centrally-sponsored scheme, the Settlement of Land to Landless Agricultural Labourers.

The Commission probed the causes and circumstances resulting in complaints of fraudulent land grabbing by influential persons allegedly having political patronage in the AIADMK.

The SLPs said that the Commission was set up without a proper resolution being passed in the Legislative Assembly and was set up on the basis of a statement made by Chief Minister M. Karunanidhi.

They contended that the constitution of the Commission was illegal for being actuated by mala fides.
