The Supreme Court on Tuesday reserved its verdict on appeals filed by the Central Bureau of Investigation and the Todi family challenging the May 18, 2010 order of the Calcutta High Court directing a fresh probe into the death of Rizwanur, a computer graphics teacher, treating it as a case of murder.
Rizwanur, who was married to Priyanka Todi, daughter of industrialist Ashok Todi, was found dead on the rail tracks at Dum Dum on September 21, 2007, a month after the marriage.
While a single judge of the High Court had directed the CBI to probe the case as one of unnatural death, a Division Bench on May 18, 2010 asked it to conduct the probe afresh treating it as a case of murder.
Both the CBI and Ashok Todi challenged the Division Bench's order contending that it could not order such a probe.
A Bench comprising Justice P. Sathasivam and Justice B.S. Chauhan reserved the verdict at the conclusion of arguments of Solicitor-General Gopal Subramaniam, appearing for the CBI, senior counsel Uday Lalit appearing for Ashok Todi, and counsel for the complainants Kishwar Jahan (Rizwanur's mother) and Rukbanur Rehman (Rizwanur's brother.)
