Observing that “there is no change in the factual situation,” a court here on Friday dismissed the bail application of Sukesh Chandrashekhar, the main accused in the Election Commission (ECI) bribery case.

Mr. Chandrashekhar had sought his release on the grounds that four of the five accused in the case had been granted bail.

Rejecting the plea, special judge Poonam Chaudhry said: “The material collected by the investigating agency so far shows that the applicant [Mr. Chandrashekhar] is the main accused. The contention of the counsel for the accused that the applicant is liable to be released on bail on the grounds of parity as co-accused T.T.V. Dhinakaran has been granted bail is without merit.”

“The applicant had collected ₹2 crore, out of which ₹1.30 crore was recovered from him at the time of the raid,” the judge further said.

Opposing the bail application, the counsel for the Delhi Police submitted that the entire money trail was to be established, and the investigation with respect to officials of the EC involved was also under process.

The police also alleged that Mr. Dhinakaran had promised to pay ₹50 crore to Mr. Chandrashekhar for obtaining a favourable order from the EC on a “two leaves” symbol. On May 22, the court dismissed Mr. Chandrashekhar’s bail application saying that “... he could tamper with the evidence”.
