A Division Bench of the Kerala High Court on Wednesday ordered that a new petition seeking to restrain the State government and the police from filing chargesheets in cases relating to the killing of BJP activists in Kannur, Palakkad, and Kollam be tagged with the pending writ petition for a CBI probe into the killing of eight BJP activists in the State.

The writ petition seeking the CBI probe into the murders of eight BJP activists will come up for hearing on November 13.

In his petition, R.K. Premdas, secretary, Gopalan Adiyodi Vakkeel Smaraka Trust, Kannur, pointed out that according to the affidavit filed by the State government, the investigation in the cases registered at the Payyanur police station, Kasba police station, and Kadakkal police station were in the final stages.

Therefore, there was no reason to hand over these cases to the CBI, the government argued in the affidavit.

The petitioner said that after the filing of the writ petition, the State government and the police were making efforts to submit final reports in these cases without making any proper investigation. The government wanted to make it appear that the investigation had been completed and final report filed.

If the police filed the final report hurriedly without any proper investigation, it would result in travesty of justice. So, an interim order restraining the police from filing the chargesheet was necessary, he contended.
