The prosecution in the 26/11 case told the Bombay High Court on Tuesday that Mohammad Ajmal Amir Kasab, convicted in the case, had assaulted a jailor at the high security Arthur Road jail.
Public Prosecutor Ujjwal Nikam said the act of the lone surviving gunman was captured on closed-circuit TV (CCTV) and a CD of the footage was submitted to the court.
On Monday, the court was hearing Kasab's plea for “a legal interview” with his lawyers, “within the sight, but not within the hearing of police personnel.”
Mr. Nikam told The Hindu over phone: “On September 1, Kasab assaulted a jailor. The CCTV captured the footage and we gave a CD to the court. He hit the staff. In the light of the threat perception to his life and even to the life of the jail staff we cannot allow an interview which is out of the earshot of the authorities.”
“We are not objecting to the interview, although the jail superintendent has the right to deny the interview. Such interview should be done in the presence of the jail personnel.”
The police also cited security reasons for leaving Kasab alone with his lawyer. They said he was a trained commando. The court would decide on the matter on Wednesday after watching the CD.
