The Karnataka High Court on Tuesday set aside the decision of the Ministry of Home Affairs to refer to the National Investigation Agency (NIA) the investigation into Rashtriya Swayamsevak Sangh worker Rudresh’s murder case.
Justice John Michael Cunha passed the order while partly allowing the petitions filed by the accused persons questioning the handing over of the probe to the NIA from the Bengaluru city police.
The Court said the city police could continue the probe as the Ministry had not properly considered the materials in taking the decision to order the probe by NIA.
The Court did not interfere in the decision of the police to invoke the provisions of the Unlawful Activities (Prevention) Act against the accused persons.
