Reliance Telecom Limited (RTL) on Monday challenged in the Delhi High Court the framing of charges against it by a designated court in the 2G spectrum case.
While framing charges against all the 17 accused under the Indian Penal Code and the Prevention of Corruption Act, Special Judge O.P. Saini on Saturday framed charges of criminal conspiracy and cheating against RTL and its officials Gautam Doshi, Hari Nair and Surendra Pipara.
The order said the accused, in pursuance of a conspiracy, had passed on to Shahid Usman Balwa and Vinod Goenka, fellow accused, a company knowing that it was ineligible on the date of applications for UAS licences. “Thereby you abetted Balwa and Goenka of Swan Telecom in obtaining Unified Access Service licences/ spectrum and thereby you committed an offence punishable under Section 109 / 420 read with 120 B IPC.”
The Anil Dhirubhai Ambani-owned RTL, in its petition, said no incriminating material had been mentioned in the charge sheet or raised by the prosecution during arguments on the charge sheet.
The charges had no basis in law. In fact, there was no act or omission attributable to the company that justified the continuation of criminal proceedings against it, the petition said.
