The Central Bureau of Investigation has registered a case in connection with the alleged gang rape of a woman and her daughter at Bulandshahr in Uttar Pradesh.
The case has been registered >following an Allahabad High Court directive on August 12. "Sections 395, 397, 376D and 342 of the Indian Penal Code, besides Section 4 of POCSO Act have been invoked," said a CBI spokesperson.
The CBI has taken over the investigation of the case that was registered at Kotwali Dehat police station in Bulandshahr on the allegations of abduction, dacoity and rape of the woman and her daughter by about half-a-dozen assailants in the fields of Dostpur village in the intervening night of July 29-30.
The Uttar Pradesh Police claims to have arrested five of the accused, whereas one of them is absconding.
A few days ago, > the family of the victims approached the Supreme Court, stating that their quest for fair justice had suffered a rude shock because of the insensitivities of the police and the “outrageous” comments made by State Urban Development Minister and ruling Samajwadi Party leader, Azam Khan. >Mr. Khan had called the crime a “political conspiracy” against the State government.
The petition filed by the family, represented by advocate Kislay Pandey, said Mr. Khan’s statement has “substantially outraged the modesty of the rape victims,” especially the minor daughter.
Arraigning the state of Uttar Pradesh, Mr. Khan, the State Police Chief and the Bulandshahr Senior Superintendent of Police as opposite parties in the case, the family accused them of causing “serious and substantive infringement of the fundamental rights of the petitioner [victims] to live a lawful life, right to equality before law and right to civil liberty.”
The family also urged the apex court to transfer the trial from U.P. to Delhi.
It asked the court to direct the State to provide the minor victim “respectable and appropriate free of cost and safe educational arrangements” till the time they get justice.
