HC refuses to grant stay on CRDA

Division Bench of Hyderabad High Court comprising Chief Justice Kalyanjyothi Sen Gupta and Justice P.V. Sanjay Kumar on  Monday refused to grant any interim orders in writ petition filed challenging  the constitutional validity of Capital Region Development Authority (CRDA) Act. The Bench, however, admitted the case  and directed the AP government to file counter affidavit.

The bench was dealing with a PIL case filed by Justice A. Gopala Rao, Justice P. Lakshmana Reddy, former judges of the High Court. The other two petitioners are senior journalist A.B.K. Prasad and senior advocate C. Sadasiva Reddy.  D. Prakash Reddy, senior counsel appearing for the petitioners, contended that several provisions of the impugned Act are not in tune with the Central legislation on Land Acquisition. He averred that when there is repugnancy, the provisions of the State enactment have to be struck down. An interim prayer to stop further activity in the name of this Act was sought for.
