Mumbai: A Shiv Sena candidate on Thursday moved the small causes court alleging that five votes were not considered in the counting for the Brihanmumbai Municipal Corporation elections, and that the victory of the Bharatiya Janata Party (BJP) candidate be quashed.

On February 23, Surendra Bagalkar of the Sena and Atul Shah of the BJP got 5,947 votes from ward no 220.
As per procedure, the municipal commissioner draws lots and whoever wins becomes the candidate of the said ward. As a result, Mr. Shah won the seat.
Mr. Bagalkar alleged that the commissioner did not inform the candidates and their agents that whether whose chit will be taken out will be the winning or losing candidate.
He also said five votes were not considered by the returning officer and they hurriedly adopted the procedure of drawing lots. He demanded that Mr. Shah’s election be considered null and void.

He also sought opening of the electronic voting machines from all the four booths of the ward by the court in the presence of the judge, himself, and Mr. Shah to find out in whose favour the votes were polled.
