Even as it maintained that there was a mismatch between the inflow of cases and the number of judges to try them, the Madras High Court has observed that the action of the Bar often “obstructed” the requirement of adequate judges.
“..existence of the malady is not in doubt, but solutions have to be given to improve the management and the functioning of the system. Most importantly adequate judges strength is required which is often obstructed by the action of the Bar,” the First Bench comprising Chief Justice Sanjay Kishan Kaul and Justice T.S. Sivagnanam said in a recent order.
The PIL filed by A.R. Kumaar of Villianur sought for a direction to authorities to maintain ‘A’ dairy in every court and give dates for every case for hearing and to prescribe outer time limit for disposal of pending cases before the High Court.
The petitioner had submitted that more than five lakh cases were pending before the Court and wondered how many years it would take with the available strength of staff and judges to dispose them of.
