HC quashes Bothra’s preventive detention order

The Madras High Court on Wednesday quashed a preventive detention order issued by the Commissioner of Police, Chennai city, in August, detaining film financier Mukanchand Bothra under the Goondas Act in order to prevent him from getting released from prison on bail. Bothra was accused of usury.

Justices Rajiv Shakhdher and N. Sathish Kumar quashed the order due to the unexplained delay of nine days from the government in considering a representation by the detainee. They said such representations must be disposed of without delay since preventive detention orders curtail the personal liberty of individuals without trial.
