HC disposes of Chinese consortium’s plea

The Madras High Court on Thursday disposed of the petition of Trishe Consortium on the ground that Tangedco has furnished relevant details.

Earlier, Tangedco rejected the bids of BHEL and CSEPDI-Trishe Consortium for the 2X660 MW Udangudi Supercritical Thermal Power Project due to some infirmities. The Consortium had moved the Madras High Court for a direction to Tangedco to furnish its order along with the reasons for rejecting the bids and scrapping the tender. When the matter came up before Justice T.S. Sivagnanam on Thursday, the Advocate-General, A.L. Somayaji, produced a copy of the State Tender Bulletin. Out of the four bids, those of two, BHEL and the Consortium were opened. Subsequently, both the bids were rejected due to infirmities which had been stated in the State Tender Bulletin. The A-G furnished a copy of the bulletin to the petitioner’s counsel.

Mr. Justice Sivagnanam said whether the petitioner should be informed of the reasons or whether the action of Tangedco was in compliance of the Tamil Nadu Transparency in Tenders Rule were left open to be considered at a later point of time.
