The State government on Thursday told the High Court of Karnataka that it had no powers to amend the Motor Vehicles Act to restrict the number of registration of new vehicles, and hence it had referred the direction issued by the KSPCB in this regard to the Union government.
However, the Bench said why the State cannot adhere to the KSPCB’s direction as it would be for those who get affected by restriction on registration of new vehicles to question legality of such order. The officials were liable for prosecution as per law if they failed to adhere to the KSPCB’s direction, the Bench pointed out.
