PIL against demolitions not maintainable: High Court

Observing that persons who are affected by the demolition of their houses built allegedly upon SWDs are entitled to approach the court in their individual capacity, the Karnataka High Court on Friday said that a PIL is not maintainable on the issue.

A Division Bench passed the order while dismissing a petition filed by T. Narsimha Murthy, who sought a direction to authorities not to demolish any house, except in accordance with law, and to implement an order passed by the Karnataka State Human Rights Commission, which had asked authorities not to demolish structures sans notice and temporary rehabilitation and relocation measures.
