She was not drunk, says friend

A prosecution witness who had booked the taxi via Uber to drop his childhood friend home on December 5, on Tuesday submitted before a court here that neither he and nor the victim were drunk.

She was sexually assaulted allegedly by accused taxi driver Shiv Kumar Yadav that night.

He also denied a suggestion by counsel for the accused that he had quarrelled with his friend and physically assaulted her before she boarded the taxi.

He submitted before the Additional Sessions Judge that his friend and he had gone for dinner to Gurgaon. When they returned to his house in Vasant Vihar, he booked a taxi to take her home. When the cab arrived near Priya Cinema market in Vasant Vihar, he verified the details, including the face of accused from the photograph on the app. He also identified Yadav, who was present in court during the trial. He further deposed that he did not drop his friend to her home in Inderlok in North-West Delhi as it was late and would have taken very long to return to his South Delhi home. The woman has already identified Yadav as her rapist and denied a suggestion that it was consensual sex.
