The Delhi High Court on Wednesday issued notice to the Ministry for Home Affairs on a public interest litigation challenging the appointment of Neeraj Kumar as Delhi Police Commissioner.
Issuing the notice, a Division Bench of Justice Darmar Murugesan and Justice Jayant Nath directed the Ministry to file a reply to the petition by May 29.
The petitioner, M. G. Devasahayam, alleged that there were allegations of misuse and abuse of power, fabrication of documents and violation of human rights against the Police Commissioner.
Mr. Devasahayam, a Chennai-based retired IAS officer, sought quashing of the appointment of Mr. Kumar as the city Police Commissioner.
The Court had on February 27 asked the petitioner to give a representation to the Ministry and directed the latter to a take decision on it within eight weeks.
Mr. Devasayam moved the Court afresh on expiry of the Court-fixed eight week time, submitting that the Ministry had taken no decision on his representation.
Before issuing of the notice by the Court, counsel for the Ministry informed the Court that the petitioner’s representation had been received and a decision on that would be taken within a fortnight.
He was apologetic to the Court for the delay in disposing of the representation by the petitioner regarding the allegations against Police Commissioner. The Court granted two more weeks to the Ministry for disposing of the representation.
