HC directs cops not to arrest MLA till May 18

The Delhi High Court on Wednesday granted anticipatory bail to AAP MLA Jarnail Singh on the condition that he cooperates with the police in their investigation, does not leave the city, and does not approach either to threaten or promise any person associated with the case. The court also directed the police not to arrest him till May 18. Mr. Singh will also have to hand over his mobile phone to the investigating officer.

The AAP MLA is accused of assaulting an MCD engineer during a demolition drive. The bail hearing went on for several hours before Justice Sunita Gupta. The lawyer of the accused, H. S. Phoolka, said that there was no substance in the argument of the police that the AAP MLA was trying to flee. “His mobile phone was on flight mode. People put their mobiles on flight mode when they do not want to be disturbed,” he said, adding that the police only wanted by, “hook or crook,” to make a case, and teach the MLA a lesson because he was from the AAP.

The police had also been directed to file a status report. They submitted that they needed Mr. Singh for custodial interrogation to recover the demolition order that he was suspected of tearing as well as to identify the people who had accompanied him during the alleged attack. The MLA has been directed to present himself at the Tilak Nagar police station at 4 p.m. on Thursday.
