A Delhi court on Monday dismissed a case against a man charged with allegedly abetting his wife to commit suicide by harassing her for dowry.
Additional Sessions Judge Manoj Jain acquitted Jagmohan alias Nitin in the case as the victim’s two brothers refused to support it. Earlier in their statements before the police, they had alleged that the accused was torturing their sister for dowry.
“All the public witnesses have not supported the case of prosecution. Vinod and Bharat (victim’s brothers), Nitesh (husband of elder sister of the victim ), and Sharvan (neighbour of the victim’s mother) have not whispered even a single word against the accused,’’ the judge said on the evidence by these witnesses.
The victim’s mother in her evidence supported the case, but in her cross-examination by the defence counsel, she showed ambivalence on some aspects.
“Shanti Devi (victim’s mother) is blowing hot and cold and it would be highly risky to hold the accused guilty on the basis of her testimony which does not seem to be of sterling quality and impeccable nature,’’ the judge said describing her evidence.
The victim had committed suicide at her matrimonial house in Sultan Puri in North-West Delhi in 2014. The post-mortem report also proved that it was a case of suicide. The accused in his statement said that his wife used to remain upset and tense because of his medical conditions.
He claimed that he was having kidney infection and later on developed tuberculosis.
