AIADMK (Amma) deputy general secretary T.T.V. Dhinakaran on Saturday refused to give his consent to the Delhi Police to take his voice sample in the Election Commission bribery case.
A Special court here on Thursday had allowed the Delhi police plea to obtain the consent of Dhinakaran for taking his voice sample. Mr. Dhinakaran denied the consent before Metropolitan Magistrate Abhilash Malhotra.
Produced before judge
Earlier, the accused was produced before Special Judge Poonam Chaudhry on a production warrant issued on Friday on a request by the Crime Branch of the Delhi Police to take his consent for the voice sample. The Special Judge later sent Dhinakaran to the Metropolitan Magistrate to record his statement on the police’s plea. Mr. Dhinakaran’s co-accused Sukesh Chandrashekhar has already refused to give his voice sample to the probe agency.
The police had sought permission of the court to take the consent of Mr. Dhinakaran and Mr. Chandrashekar to take their voice samples to match them with those contained in a CD recovered during the investigation.
The AIADMK (Amma) leader had earlier challenged the maintainability of the police’s plea.
Counsel for Mr. Dhinakaran argued that there was no provision in the Cr.PC which permitted the investigating officer to move an application in the court during the pendency of the investigation to obtain voice sample of an accused. The court could not entertain the police’s plea as it could not interfere in the course of investigation, Mr. Dhinakaran’s counsel further submitted.
