The Supreme Court has warned ‘advocates on record’ for simply lending their names for filing cases without actual presence in the court.
Finding advocate on record (AoR) Rameshwar Prasad Goyal not present in the court despite repeated calls, a Bench of Justices B.S. Chauhan and S.A. Bobde, issued a show cause notice to him as to why his licence as an AoR should not be suspended/cancelled.
The Bench was dealing with an application filed by Mohammed Israfil for restoration of the appeal, which stood dismissed in default by an order on March 8.
The Bench said, “Many of the contents in the application do not seem to be factually correct. In order to understand the same, we wanted an explanation and clarification from the AoR, who has signed the application for restoration. When the matter was taken up in the second round, we were informed that AoR Rameshwar Prasad Goyal refused to come to the court. It has been pointed out that he is the AoR who has filed an extremely large number of cases in this court but never appears in the court. In view of his refusal to come to the court, we have no option but to dismiss the application. However, his conduct makes it necessary for us to issue a show cause notice to him.”
Issuing the show cause, the Bench said his conduct amounted to interfering with the administration of justice and results in multiplicity of proceedings. He may file his explanation within three weeks.
