Can MCOCA be slapped on Hasan Ali, court asks police

A special MCOCA (Maharashtra Control of Organised Crime Act) Court on Saturday directed the Mumbai Commissioner of Police to investigate if there was any ground on which the Act could be slapped on Pune-based businessman Hasan Ali Khan, held on the charge of money laundering.

Special MCOCA judge S.M. Modak issued the order after hearing an application from activist Ishwar Prasad G. Khandelwal, requesting that the MCOCA be imposed on Hasan Ali. The order comes a day after Hasan Ali's bail plea was rejected by the Supreme Court.

“The Commissioner of Police has been directed to appoint a police officer for carrying out investigation for submitting a proposal for approval as required under clause (a) of section (1) of section (3) of the MCOCA,” the operative order said.

The court said the competitive officer was at liberty to take a decision on granting approval for applying the MCOCA, and asked the Commissioner to inform it of the progress in the probe within a month.

Mr. Khandelwal told The Hindu : “The court said that the ingredients in my application that Hasan Ali is linked with Adnan Khashoggi and has generated illegal wealth from weapons sale need inquiry and investigation. Therefore, it directed the Commissioner of Police, who has the discretion to decide if the MCOCA can be applied, to investigate the matter.”
