The Madras High Court bench here closed a habeas corpus petition filed by the wife of Kichan Buhari, a suspect arrested in connection with the Bangalore bomb blast.
Buhari’s wife Jameela Banu filed the petition on April 23 alleging that her husband was taken into illegal custody by the police in Melapalayam in Tirunelveli on April 22.
He was detained by the Special Investigation Team (SIT) that probed the case relating to planting of a pipe bomb under a bridge near Tirumangalam ahead of the visit of former Deputy Prime Minister L.K. Advani to Madurai in October 2011, she claimed.
In her petition, Mrs. Banu claimed that nobody in her family knew where Buhari was detained by the SIT. Buhari, a social activist, was assisting senior lawyers in the Coimbatore bomb blast case, she further claimed.
The case was heard by a division bench comprising Justices S. Rajeswaran and T. Mathivanan. On Thursday, the bench closed the case recording the submissions made by the government pleader.
The government pleader submitted that Buhari was arrested by the Bangalore police at Mattuthavani bus stand on April 23 and was subsequently produced before the Judicial Magistrate in Bangalore.
“Though the petitioner has disputed the place and date of arrest, the details cannot go into the habeas corpus petition. It is open to the petitioner to work out her remedy before the appropriate authorities,” the judges observed in their judgement.
