A Delhi court has acquitted two persons of sexually assaulting a woman and later entering into a conspiracy to sell her, as the victim gave a clean chit to them.
About accused Gulbahar Ali, the victim said in the trial of the case that she had established physical relations with him of her own accord. As regards the second accused, Sayed Ali, she said he had committed no crime against her. She also failed to identify him in the court. Rather, she urged the court to acquit both the accused. She further deposed that Gubahar had married her as promised by him before he brought her to Delhi from Assam and both of them were living happily.
The prosecution had charge-sheeted Gulbahar for establishing sexual relations with the woman thrice in Assam. He later brought her to Delhi promising to marry her and get her a job. But he instead raped her at Sayed Ali’s house when she was alone, the prosecution alleged.

It was also alleged that the accused had entered into a conspiracy and were selling her. The victim had lodged a case against the two accused at the Khyala police station. She had later reiterated the charges while recording her statement before a Metropolitan Magistrate. But in the trial of the case, she gave a spin to her allegations. She said she had lodged the case following some misunderstanding between her and Gulbahar, and at the instance of her well-wishers.
“From the above discussion, it is clear that the claim of the prosecution is neither reliable nor believable and is not trustworthy, and the prosecution has failed to establish the offences of rape on a false pretext of marriage and conspiracy of selling her,” Additional Sessions Judge Nivedita Anil Sharma said, while acquitting the two accused.
