The Central Bureau of Investigation may not name former Gujarat Home Minister Amit Shah in the supplementary charge sheet to be filed in the Ishrat Jahan encounter case, said agency sources. The CBI has already filed the first charge sheet against the policemen directly involved in the alleged killing of Ishrat Jahan and two others about eight years ago.
While CBI spokesperson said the decision to file the additional charge sheet was still under consideration, sources said investigations conducted so far had not thrown up concrete evidence indicating Mr. Shah’s involved in the conspiracy behind the “fake” encounter.
The agency plans to file the second charge sheet in connection with the alleged conspiracy hatched to eliminate Ishrat and the other two in a stage-managed encounter. Accordingly the agency probed the suspected role of four Intelligence Bureau officials and the then political masters.

While senior CBI officials earlier said that no sanction was necessary to prosecute the intelligence officials as the activities they allegedly indulged in were beyond the nature of their duty, unconfirmed reports suggested that the agency has now sought a legal opinion in this regard as a precautionary measure.
The CBI in the first charge sheet named police officers, P.P. Pandey, D. G. Vanzara, G. L. Singhal, Tarun Barot, N. K. Amin, J. G. Parmar and Anaju Chaudhary as accused.
