High Court rejects Rubabuddin's petition

To join as a party in the hearing of Amit Shah's bail plea

The Gujarat High Court on Friday rejected the petition of Rubabuddin Sheikh, brother of Sohrabuddin, that he be impleaded as a party in the hearing on the bail application of the former Minister, Amit Shah.

Sohrabuddin was killed in a fake encounter on the outskirts of Ahmedabad in 2005, and Mr. Shah is the prime accused in the case.

Confirming the special CBI court order, Justice Akil Kureshi said Rubabuddin could oppose the bail plea or submit evidence and documents through the CBI advocate but could not directly become a party in the case. The court accepted the arguments of Mr. Shah's advocate that Rubabuddin was not a victim in the case and could not be a respondent in the hearing on the bail plea.

Rubabuddin said Mr. Shah should not be given bail as he was likely to tamper with evidence and hamper the probe which was in a crucial stage.
