A Delhi court on Tuesday refused to grant bail to AAP MLA from Okhla Amanatullah Khan in a case of allegedly threatening a woman with rape and murder when she had visited his home with a complaint about power cuts in her locality.

‘May influence witnesses’

Metropolitan Magistrate Manisha Tripathi dismissed his bail application and sent him to judicial custody till August 9, stating that he might influence witnesses and hamper investigation if released on bail.

“Considering the facts and circumstances of the case, the nature of allegations and material on record, I am of the opinion that the accused might influence witnesses and hamper investigation if released on bail at this stage. Accordingly the application for bail is dismissed,’’ the Magistrate said in her order.

Seeking bail, counsel for the accused argued that the case was an attempt to falsely implicate the MLA.

Opposing his bail application, Special Public Prosecutor Rajiv Mohan submitted that that the probe into the allegations was still on, and the accused might influence the witnesses and hamper probe as the complainant was being constantly threatened and harassed at his behest.

Earlier, the police produced Mr. Khan before the court on the expiry of his one-day police remand and urged it to send him to judicial custody.

The incident

The woman, who was earlier reportedly associated with the AAP, in her complaint said that she had called up the MLA on his mobile phone on July 10 to complain about power failure in her area.

When her complaints were not addressed, she visited the MLA’s house in Jamia Nagar, which she found locked from inside.

Therefore, she decided to return, having heard no response from inside.

She had just walked back a few steps when a young man opened the gates, hailed her and threatened to get her sexually assaulted and burnt alive, stating that he was just conveying the threats of the MLA, the woman alleged.
