The Whitefield police have registered a suo motu case against Mohammed Mustafa, the dismissed skating instructor at a Marathahalli school, for his alleged misconduct in a school in Whitefield where he worked earlier. Though Police Commissioner M.N. Reddi, on Tuesday, said Mustafa was not directly involved in the rape of the six-year-old student in the Marathahalli school, a fresh FIR was registered against him on Monday.
He has been charged under section 354A (sexual harassment) of the IPC and section 11 of the POCSO Act. Mustafa is in police custody in connection with cases related to both the Marathahalli and Whitefield schools.

While the POCSO Act came into effect only in 2012, Mustafa has been booked under its section for the alleged incidents of misconduct in 2011. However, the school has not been booked under the same Act.
When asked about this, the police said that no complaint had been filed against Mustafa’s behaviour in the Whitefield school and therefore they could not book the school under the Act. Though the same rule applies to Mustafa, the police have booked him under the Act.
“We have also booked him under the IPC and will have to consult a legal team to check if the POCSO Act can be sustained against him in this case,” said Additional Commissioner (Law and Order) Alok Kumar.
