Institute questions denial of permission to admit 1st year students

State-run Koppal Institute of Medical Sciences, Koppal (KIMS), has moved the Karnataka High Court questioning the decision of the Ministry of Health and Family Welfare denying to renew permission for admission of students to the 1st year MBBS course for the academic year 2018-19.

The KIMS-Koppal has claimed that the Ministry and the Medical Council of India (MCI), which had inspected the institute and found certain deficiencies, such as shortage of teaching staff, shortage of residents, had failed to consider the compliance reports on rectifying the deficiencies that was submitted by the institute in May 2018.

It has been contended in the petition that public notice declining permission for admission for the year 2018-19 was issued without issuing any notice or opportunity of hearing to the institute as per the provisions of the MCI Act.

Referring to shortage of faculty by 35% as indicated in the MCI’s second inspection report of April 2018, the institute claimed that some of the permanent teaching staff were absent at 11 a.m. on the day of the MCI inspection and it did not consider the documents produced to show that they were permanent staff.

The institute has claimed that it had rectified all the deficiencies, but the MCI had failed to consider the compliance report before recommending to the Ministry against renewal of permission. Claiming that there had been no communication from the Ministry on disapproval, the institute has contended that the Ministry should have ascertained the MCI’s report through an independent agency before taking the final decision.

Meanwhile, the Ministry on Friday submitted to the court a copy of the order dated May 31 disapproving the permission to admit first year students.

A Division Bench comprising Justice H.G. Ramesh and Justice Mohammad Nawaz, before whom the petition came up for hearing, has adjourned further hearing till June 25.
