Division Bench defers final order

The two-member Division Bench of the Gulbarga Bench of the High Court of Karnataka deferred passing final orders in the case challenging the admission of a student to the Post Graduate Diploma Course in Obstetrics and Gynaecology in M.R. Medical College.

The case came up before the Division Bench consisting of Justice L. Narayanaswamy and Justice A.S. Pachapure in the Gulbarga Bench of the High Court of Karnataka on Thursday. According to senior advocate representing the petitioner Sha-be-Mehraj Banu, who had challenged the admission of Devika Sengupta to the course, the case now would be posted before another Division Bench.

The contention of the petitioner was that she was promised of the seat and had made part payment of the fee sought by the society. However, instead of giving her the seat the society had allegedly allotted the seat to Dr. Sengupta, who according to the petitioner, had not appeared in the qualifying entrance examination.

Initially High Court Judge S.N. Satyanarayana had passed an order asking the Criminal Investigation Department to investigate the alleged irregularities in the admissions to the Post Graduate courses in the college and also quashed the admission of Dr. Gupta. However, on November 6, the Division Bench of the High Court of Karnataka stayed the orders. The Division Bench also allowed Dr. Gupta to continue her studies.
