Man gets 10-year RI for raping his mentally challenged niece

Judge K. Ramesh Bhai found Kulamullakandil Yoosuf, 33, of Marad, guilty under Section 376 (rape) of the Indian Penal Code.

The Kozhikode Additional Sessions Court-I has awarded 10 years of rigorous imprisonment and a fine of Rs.10,000 to a person who impregnated his mentally challenged niece two years ago.

Judge K. Ramesh Bhai found Kulamullakandil Yoosuf, 33, of Marad, guilty under Section 376 (rape) of the Indian Penal Code.

The fine amount has to be compensated to the victim. If the accused refused to remit the penalty, he would have to undergo another six months of rigorous imprisonment.

The 20-year old girl was staying with her parents, and Yoosuf used to assist them.

Frequent occurence

The prosecution case was that the accused had raped his niece on several occasions when her mother, a daily wage earner, went to work.

The pregnancy of the victim came to light when she was taken to hospital after she complained of stomach ache.

Yoousf, who was an auto rickshaw driver, took her to the hospital, in his own vehicle.

The victim delivered a baby in the toilet of the hospital.

However, the accused abandoned the baby in a shrub on the premises of the hospital.

A security guard on the adjoining building of the hospital spotted the body of the baby the next day.

A separate case was filed against him by the police in connection with that incident.
