A Delhi court on Thursday refused to grant interim bail to former Delhi Law Minister Jitendra Singh Tomar in the fake degrees case.
Additional Sessions Judge Sanjeev Jain rejected the plea of Mr. Tomar’s counsel, Ramesh Gupta, in view of the prosecution stand that it was not in a position to assist the court in the hearing.
The court was hearing Mr. Tomar’s plea for regular bail in the case.

The prosecution expressed its inability to assist the court, submitting that the case file was with the investigating officer and he was out of town along with the accused pursuing further investigations.
Thereupon, Mr. Gupta requested the court to grant interim bail to the former Minister in view of the Allahabad High Court and the Supreme Court judgments which say that the court should do so, if the prosecution seeks adjournment of hearing on a bail application.
He also questioned the prosecution submission that the case file was not with it, informing the court that under the rule, three copies of a case file should be created and one of them should remain with the Assistant Commissioner of Police overseeing the investigation.

Of the remaining two copies, one is made available to the investigating officer and the other is kept in the Criminal Records Room, Mr. Gupta further submitted.
However, the judge refused to accept the plea, saying that “order for interim bail will further complicate the matter”.
He adjourned the hearing on the regular bail application for June 16. Mr. Tomar’s police custody ends on Friday.
