High Court directions on HCA

The Committee, appointed by the High Court, comprising Justice Anil R. Dave (retired Judge of Supreme Court) and Justice G.V. Seethaparhy (retired Judge of High Court) and Prof Ratnakar Shetty, shall continue to be in place until further orders. This was the direction given by a two-member Bench of the High Court comprising Justice V. Ramasubramanian and Justice J. Uma Devi on Wednesday, while disposing off various applications regarding the administration of Hyderabad Cricket Association (HCA).

“The CEO of HCA shall directly report to the said Committee and shall act only in accordance with the directives issued by the Committee,” it directed. The Committee, in turn, has been requested to have a new set of bye-laws prepared for HCA, incorporating all the amendments so far suggested by the Court. The amended bye-laws have to be registered with the Registrar of Societies, which also has to be authenticated and presented to the Registrar of Societies through the CEO of HCA.

The two-member Bench further authorised the Committee to take the assistance of the BCCI or assistance of any lawyer/law firm for preparing the set of amendments to be carried out to the bye-laws of HCA. The Committee has been entrusted the power to fix the terms of the lawyer/law firm engaged by them for preparing the amendments.

The task of shortlisting players from Telangana to be sponsored for various tournaments mentioned by the BCCI in their applications, is also entrusted to the Committee.

However, before relying on the selectors, the Bench has urged the Committee to check their credentials.

The directions of the Bench made it clear that in the event of necessity of fresh elections, the Committee was empowered to take requisite steps to hold the elections.

In order to remove all doubts, it also stated that, the Committee appointed by the Court shall have all the powers of the Apex Council and is thereby requested to file status reports before this Court, once in two months, the first of such reports being immediately after the registration of the amendment to the bye-laws after sponsoring players for the tournaments in the current cricket season.
