Keep deportation order on Senthuran in abeyance: HC

A Sri Lankan Tamil facing a deportation order has got a respite with the Madras High Court on Wednesday directing the authorities to keep the order in abeyance till a final order is passed on a fresh representation to be submitted by him within 15 days.

If the final order is against him, he may be given some time to work out his own remedy in a manner known to law, the court said.

A Division Bench, comprising Justices S. Rajeswaran and A. Arumughaswamy, passed the order on a petition by R. Senthuran.

The petitioner said he was employed here. The proposal to deport him to Sri Lanka was arbitrary and against the principles of natural justice.

Disposing of the petition, the Bench said that before adverting to the merits of the case, the Advocate-General, A.L. Somayaji, submitted if the petitioner would give a detailed fresh representation ventilating his grievances to the Secretary, Public, it would be considered as per law. The petitioner’s counsel agreed to this. The Bench recorded the submission.

In view of this, the court said it was disposing of the petition with the direction to Mr. Senthuran to make a detailed representation. The Secretary, Public (foreigners department) should consider the plea and pass orders within eight weeks on merits and in accordance with law. The islander should not be deported till the order is passed.
