Judge say it is unfair on the part of couple’s counsel to have not filed a sub-application for a DNA test all these days.

The Madurai Bench of the Madras High Court on Thursday stayed all further proceedings in a maintenance case filed by a Melur elderly couple claiming actor Dhanush to be their biological son.

Justice G. Chockalingam granted the interim stay, until further orders, after pulling up counsel for the Melur couple for making a plea for a DNA test at the final hearing of a petition filed by the actor to quash the maintenance case.

After the actor’s counsel opposed the plea for a DNA test, the judge said it was unfair on the part of the couple’s counsel to have not filed a sub-application for a DNA test all these days.

Further pointing out that his tenure in the Madurai Bench ends on Friday, the judge adjourned the hearing on the quash petition as well as other sub-applications to March 9.

“You argue the case before my successor. There is no time for me to hear the case. I have only one more day left here,” he told counsel for both sides.
