The Supreme Court on Friday issued notice to the Central Bureau of Investigation on Rajesh Talwar's petition seeking transfer of the Aarushi murder case trial from Ghaziabad to Delhi, citing security reasons.
Fourteen-year-old Aarushi, the only daughter of the Talwars, was found dead with her throat slit at the family's Noida residence on the outskirts of Delhi on May 16, 2008 and the body of their domestic help, Hemraj, was found on the terrace the next day. Refusing to accept the closure report filed by the CBI in December 2010, the trial court took cognisance of the case.
Aggrieved, Dr. Nupur Talwar challenged the order before the High Court, which on March 18, 2011 dismissed her plea. The next day, the Supreme Court stayed all further proceedings and on January 6 this year the court disposed of the matter, paving the way for the trial. The Ghaziabad court has fixed the case for hearing on Saturday.

Ahead of this hearing, the Talwars moved the Supreme Court for transfer the trial to a court in Delhi. Besides citing the attack on Dr. Rajesh Talwar on the court premises, the Talwars also said that most of the witnesses were in Delhi.
Senior counsel Harish Salve, appearing for Dr. Talwar, pleaded for adjournment of the case scheduled for Saturday. The Bench, while issuing notice, said if an application was made by the Talwars seeking adjournment of the case, the trial court would consider the same.
The Bench granted four weeks for the CBI to file its response.
