The Supreme Court on Monday refused to hear the application of the Cricket Association of Bihar to restrain BCCI chief N. Srinivasan from participating in the International Cricket Council (ICC) polls scheduled on June 27 as a nominee of the BCCI.
A vacation Bench of Justices Vikramajit Sen and Shiva Kirti Singh refused to accept the plea of senior counsel Nalini Chidambaram, appearing for the association, that the court should take up the application which was already pending adjudication. She said, “We expected that he [Mr. Srinivasan] will not assume charge as the Justice Mudgal panel has been appointed to probe into the allegations [of betting and spot-fixing in IPL].”
The counsel for the BCCI, however, opposed the plea stating that last week a vacation Bench headed by Justice Khehar had refused to entertain the application stating that the earlier order was clear and that they were now making a fresh attempt. Justice Sen then told Ms. Chidambaram, “Once an earlier Bench had refused to entertain your request, this application can wait till the court vacation.”

In its application, the association wanted a direction not to allow Mr. Srinivasan to be a nominee of BCCI in the ICC as he was disentitled to function in Council on grounds of maintaining institutional probity and integrity from continuing in BCCI.
