High Court orders CBI probe

The Kerala High Court on Wednesday ordered a CBI probe into the alleged attack on a police constable who was suspected to have leaked information to Kollam-based journalist V.B. Unnithan on the participation of police officers in a party thrown by liquor barons.

Justice V.K. Mohanan ordered that the notification in this regard be issued in one month.

The court observed that the link between the attack on Mr. Unnithan and the attack on the petitioner, Babu Kumar, could not be ruled out. It was only just and proper to entrust the probe to the CBI which had investigated the attack on Mr. Unnithan and was probing the death of Happy Rajesh. The contention of the petitioner that the attack on him was part of a chain of incidents could not be brushed aside.

Counsel for the petitioner Krishnakumari K.R. contended that though the crime was registered on January 11, 2011, there had been no progress in the investigation. When the Chief Judicial Magistrate Court, Kollam, called for a report, the police reported that Happy Rajesh and Container Santhosh were present when the constable was attacked. The attack on the petitioner, subsequent to the attack on Mr. Unnithan, and the death of Rajesh had been linked with each other. The real culprit had not been arrested so far.

The court noted that no progress had been made in the investigation since the crime was registered on January 11, 2011. No one was seen contacted by the CBI officials who conducted the investigation in the Unnithan attack case and the Happy Rajesh murder case, to find out whether the accused in the case had any link with these cases.
