The Kerala High Court on Thursday issued notice to the Central Bureau of Investigation (CBI) on a petition filed by actor Dileep, one of the accused in a case relating to the sexual assault on a woman actor, seeking a CBI probe into the case.
Opposing the plea of the actor, senior government pleader Suman Chakravarthy submitted that the plea was a tactic to protract the trial in a case in which the charge-sheet had already been filed.
The case was now pending trial before the Ernakulam Sessions Court. He further argued that Dileep could not raise the ground which was available for his defence during trial to seek a CBI probe.

Dileep in his petition contended that he was falsely implicated in the case. He claimed that he was not involved in the case. It was because of the dishonest, mala fide and meaningless investigation by the police that he was implicated in the case.
According to Dileep, the investigation in the case was an antithesis to the principles laid down by the Supreme Court. The Special Investigation Team controlled by the high echelons of police, including State Police Chief, had conducted a biased probe, he alleged. The actor also claimed that there was no material even to remotely connect him with any of the other accused or the incident alleged in the case. Despite that, the petitioner was roped in with a sinister motive.
Therefore, he argued, a CBI probe was essential for a fair and impartial investigation into all aspects, especially with regard to the real nature of the incident and conspiracy which had led to the registration of the case.
