Dileep plea for CBI probe dismissed in woman actor sexual assault case

The Kerala High Court on Wednesday dismissed a plea of Malayalam cinema actor Dileep, one of the accused in a case relating to the sexual assault on a woman actor , for a CBI probe into the case.

Dileep in his petition had contended that he was falsely implicated in the case. He claimed that he was not involved in the case. It was because of the dishonest, mala fide and meaningless investigation by the police that he was implicated in the case.

Opposing

the plea of the actor , senior government pleader Suman Chakravarthy submitted that the plea was a tactic to protract the trial in a case in which the charge-sheet had already been filed.

The case was now pending trial before the Ernakulam Sessions Court. The Government Pleader further argued that Dileep could not raise the grounds available for his defence during trial to seek a CBI probe.

The Special Investigation Team, controlled by the upper echelons of police, had conducted a biased probe, the actor had alleged. He claimed that there was no material even to remotely connect him with any of the other accused or the incident alleged in the case. Despite that, the petitioner was roped in with a sinister motive.

A CBI probe was essential to conduct a fair and impartial investigation into all aspects, especially with regard to the real nature of incident and conspiracy which had led to the registration of the case, he had argued.
