Kanimozhi moves Supreme Court for bail

Denied bail by the Delhi High Court, DMK MP Kanimozhi and promoter and director of Kalaignar TV Sharad Kumar, both accused in the 2G spectrum case, moved the Supreme Court on Friday.

Both were remanded in judicial custody by the CBI special court on May 20 and since then they have been in the Tihar jail.

A special leave petition filed by counsel V.G. Pragasam assailed the High Court order, saying that the Rs. 200 crore received by Kalaignar TV was only a loan and it was repaid with interest. The SLP comes up for hearing before a vacation Bench of Justices B.S. Chauhan and Swatanter Kumar on June 13.

It said the entire business transaction was transparent and the payment was made through bank. This transaction was imaginarily portrayed as receipt of bribe on the basis of belated and oral statements of obliged witnesses, it said.

The petitioners said that as they voluntarily appeared in court upon receipt of summons, they were protected from being remanded in custody, in view of the recent binding judgments of the High Court itself.

They denied any role in the alleged conspiracy in spectrum allocation.
