The Union Home Ministry has sought the case diary of >Ishrat Jahan “fake encounter” case to arrive at an “informed” decision on a request by the Central Bureau of Investigation for sanction to prosecute four accused Intelligence Bureau officials, including former Special Director, IB, Rajendra Kumar.
The MHA has for the time being turned down the request for prosecution sanction stating that details of the case have not been provided to make a decision and therefore, it requires access to the case file.
However, the agency is reluctant to share the file and has instead sought legal opinion on the issue. A case diary, which remains with the investigating officer, can only be produced in court.

Along with Mr. Kumar, three other former State IB officials — M.K. Sinha, P. Mittal and Rajiv Wankhede — have been named as accused in the case along with the Gujarat Police officers.
The CBI had earlier filed the first charge sheet against the accused Crime Branch officers of the Gujarat Police. The second charge sheet prepared on the basis of investigations into a larger conspiracy, which accuses four former IB officials of involvement, is yet to be admitted in the court.
