Q: My husband and I are permanent residents of USA and we have sponsored our son and daughter for a Green Card. The application has been accepted and it is under process. Would our children be allowed to visit us for a short while? If permitted to do so, what visa application would be in order?

A: The fact that your children have an immigrant visa case pending is not an automatic bar to obtaining a non-immigrant visa. If your children want to visit you, then they should apply for B1/B2 tourist visas. “Dual intent” is an applicant having the long-term intent to immigrate, but short-term intent to visit and return. This can be difficult for the consular officer to assess. The officer will have to look at a variety of facts pertaining to the case. All we can promise is that we will take each applicant on a case-by-case basis.

Q: I have applied K1 Visa to my fiancee on Sept 23rd 2009, I haven’t heard anything from the consulate about the process, when checked online status, it say initial stage. Now I am worried whether they mailed out the packet to my fiance, or lost in mail, which usually happens. Can you please let me know the procedure how to get in touch with the USCIS and also like to know where the interview is conducted if the applicant (My Fiancee) is in Hyderabad.

A: While a K1 visa is technically a non-immigrant visa; it is processed only at posts that issue immigrant visas. U.S. Consulate General, Hyderabad only issues non-immigrant visas. You have not said at which consulate you have applied for your fiancé’s K1 visa. The closest Consulate General to Hyderabad which processes immigrant visas is Chennai and that is probably where her information will be sent and where she will be interviewed. Q: I work for a multinational company in India. My company is processing an L1 visa for me to travel to US for project requirements. However, I am facing a peculiar issue. The ‘Surname’ in my passport is blank and my whole name appears in the ‘Given name’. I was told by my company’s immigration team that in such a case, I might face problems with my L1 visa, the port of entry in US and so on. So, I’ve been asked to do a name correction on my passport.

I would like to ask you as to how serious is this issue because my travel and project plans have taken a back seat.

A: Under U.S. immigration law, the name on the passport and the name on the visa in it must match. How your name is stated in your passport should not affect your visa application and as long as the names on the passport and the visa match, it should not affect you at the port of entry. It is up to you how to determine whether you want to agree with your company immigration team’s suggestion to changing your name in your passport.

Q: I travelled to US on B1 (Business visa) on Jan-2009 and returned in April 2009 (stayed for nearly 86 days and returned on time). While returning I did not return my I94 form at the port of exit because by mistake my I94 form was kept in my main luggage. I informed the officer about the same when I94 was asked.

My question is will this be a problem when I need to visit USA in future? I assume that my return journey would have got recorded in their system with the help of my passport details.

A: Because you left the U.S. within the legal timeframe as provided by Department of Homeland Security at the port of entry, it should not block any future entries into the United States. However, please be prepared with your explanation for the port of entry authorities in case there is any question.

If you have not returned your I-94, it should be mailed to: ACS, Inc., 1084 South Laurel Road, London, KY 40744, USA

Return the I-94 Departure Card only to this address. Do not mail it or any supporting information to any U.S. Consulate, Consulate General or Embassy, or to any other DHS office in the U.S., or to any address other than the one stated above. It is only possible to make the necessary corrections to DHS records to prevent inconvenience or possible repercussions in the future at this address. It would behove you to keep a copy of the I-94, as well as the passport pages that show the date you actually left the U.S.

Q: Kindly inform me whether it is necessary to get Police clearance certificate (PCC) requirement letter from your office if I want to send my fingerprints to the employer in USA. Is it a prerequisite to submit PCC to local Police station to have my fingerprints? They asked me to bring PCC requirement letter from US consular office or else they will not allow me to apply for fingerprints.

A: The U.S. Consulate General neither requires nor provides such a letter. Please contact your local Police Department for more information.

Q: I am a US Permanent Resident, live in US and I would like to invite my mother on a visit. Could you please guide me through the procedure or steps as to get her a visa.

For their visa interview, applicants for a tourist visa should bring their passport, application form DS-156, HDFC Bank receipt and any documents that they think might support their case. Among those supporting documents, they may wish to bring documents that help to establish that they have a residence outside the United States which they do not intend to abandon; that they are coming to the United States for a definite, temporary period; that they will depart upon the conclusion of the visit; and that they have sufficient funds to cover their expenses during the visit. We strongly recommend applicants not finalize their travel program or complete payment for any service until they have received their visa.
