Janata Party president Subramanian Swamy said here on Friday that he would file a criminal case against the former Union Telecommunications Minister, A. Raja, before the Special Court for Corruption Cases in the first week of December in connection with the charges of irregularities in 2G spectrum allocation.

As Mr. Raja had resigned from the Union Cabinet, there was no need to seek sanction for his prosecution, Dr. Swamy told presspersons and added that he was compiling documents to move the court. Once the court issued an arrest warrant against the former Minister, Dr. Swamy said that under Section 319 of the Criminal Procedure Code, he would name the other “beneficiaries” in the scam.

The Comptroller and Auditor-General's report had put the presumptive loss to the government at Rs.1.75 lakh crore, but according to Dr. Swamy, the gratification shared would be only about Rs.60,000 crore.
Referring the case to the Central Bureau of Investigation was not the appropriate response to a petition seeking prosecution sanction and it was against the Supreme Court verdict, Dr. Swamy said. Prime Minister Manmohan Singh should have accorded sanction or declined it in three months time, he said, appreciating the court's firm stand on this issue.
To the criticism over the Prime Minister patting Mr. Raja at a recent function, Dr. Swamy said it would have been just a casual gesture.

Dr. Swamy said he had always maintained that the Prime Minister had no role in the irregularities. But, if Dr. Singh failed to cancel the 2G spectrum licences and initiate legal action against all the “beneficiaries,” he would be compelled to seek the Prime Minister's resignation.
