Supreme Court disallows plea on Prabakaran’s mother

The Supreme Court on Friday declined to entertain a petition for a direction to the Union government to bring forthwith the ailing mother of the slain LTTE leader V. Prabakaran from Colombo by a special plane for treatment in Chennai.

A Bench of Justice P. Sathasivam and Justice H.L. Dattu disposed of the special leave petition on the ground that the Madras High Court was seized of the matter and had listed the case for further hearing on June 10. The Bench gave the petitioner, Chennai-based advocate R. Karuppan liberty to pursue the matter in the High Court.

Mr. Karuppan filed the SLP against an order of the Madras High Court asking him to make a representation on behalf of Parvathi Ammal or get the representation from her and submit it to the Tamil Nadu government within two weeks. After receiving a representation, it would place the matter before the Union Government within two weeks thereafter for its consideration, the court said.

When Mr. Karuppan said the 86-year-old Parvathi Ammal required urgent medical assistance, Justice Sathasivam told him that the High Court had given him the opportunity to make a representation and thereafter it would be considered by the Centre. Justice Sathasivam told the petitioner “you wait for the Centre's decision. The High Court has not closed your case. It is listed for hearing on June 10. We can't entertain this matter at this stage.”

Mr. Karuppan said the woman was suffering from paralysis and other ailments and she required urgent medical attention. After the April 30 High Court order, he faxed a representation on her behalf on May 1 but it was neither acknowledged nor acted upon. However, an alleged email, purportedly sent by her, was sent to the Centre, Mr. Karuppan said. He wanted a direction to the Centre to send a special plane to Colombo to bring the woman for providing treatment in Chennai on humanitarian grounds.
