Hasan Ali case: Decision on Patna police request on May 7

A sessions court would now hear on May 7, the application filed by Arthur Road Central prison seeking permission to send Hasan Ali Khan, accused of money laundering, to Patna in connection with a passport forgery case.

The application came up for hearing on Wednesday before Principal Judge Swapna Joshi who adjourned it to May 7, when Mr. Khan would be produced before her for extension of remand.

The Patna police had on Tuesday approached the court seeking Mr. Khan’s custody. They presented a production warrant issued by the chief judicial magistrate of Patna as Mr. Khan is required in the passport forgery case of 1997 there.

Mr. Khan’s counsel, I.P. Bagadia, however, objected to the plea saying the production warrant was addressed to the Arthur Road Jail and not to the court. Hence it should be returned.

However, the State, through Govind Patil, additional senior jailer of Arthur Road, then made an application saying that the sessions court in Mumbai could direct the jail authorities to send him to Patna, as Mr. Khan is in court custody now.

Mr. Khan is in judicial custody till May 7. The court would also hear on May 4 his plea seeking medical assistance. He has pleaded that he is a diabetic and needs immediate treatment.
