Maoist leader Kobad Ghandy on Wednesday moved the Delhi High Court challenging a city court order allowing the Special Cell of the Delhi police to conduct a narco-analysis test on him. His petition is likely to be taken up for hearing on Wednesday.
Counsel for Ghandy submitted that the trial court order was erroneous as the police did not take prior permission from his client to undergo the test. He submitted that an accused could not be compelled to incriminate himself. He pointed out that the Supreme Court was also of the view that prior permission of the accused should be taken. Further, it was still seized of a petition challenging the scientific validity of the test, the petitioner said.
The trial court had on October 31 allowed the Delhi police to conduct the test on Ghandy. He was arrested in the capital in September.
