Mojo co-owner’s bail to be heard on Jan. 11

Costly negligence: The two managers of 1Above, Kevin Bava and Lisbon Lopez, outside the Bhoiwada court on Tuesday.

Mumbai: The Civil and Sessions Court will hear the anticipatory bail plea of Yug Tulli, co-owner of Mojo Bistro, on January 11, in connection with the fire that killed 14 people and injured 50.

The 29-year-old businessman from Nagpur has been charged under Section 304 (punishment for culpable homicide not amounting to murder), Section 337 (causing hurt by act endangering life or personal safety of others), Section 338 (causing grievous hurt by act endangering life and personal safety of others), and Section 34 (acts done by several persons in furtherance of common intention). He is absconding.

His plea said that Mojo Bistro and 1Above share a common wall, and his restaurant has all the permissions from the fire department and has complied with all the regulations required. He also said that Mojo Bistro has a proper fire exit.

The plea mentioned the account of an eyewitness, whose statement is relied upon in the fire report that said that those who were present there saw the fire first in the east side of 1Above, and no casualty from Bistro was reported.

A man who lost his wife to the fire has also filed an intervention opposing Mr. Tulli’s bail plea. The court has directed the prosecution to file a reply.

Yug Pathak, co-owner of Mojo Bistro, is in police custody till January 12.

Meanwhile, the Bhoiwada court has sent two managers of 1Above — Kevin Bava and Lisbon Lopez — to judicial custody till January 22. Their bail application will be heard on Wednesday.
