The Madras High Court has directed a person to pay Rs.2.11 lakh towards the college fees for the third and fourth years of his son in two instalments. The first instalment should be paid within 10 days and the second within a month thereafter.
Justice S. Manikumar passed the order on a petition by a person challenging an order of the First Additional District and Sessions Judge, Coimbatore. The Sessions Judge had modified an interim order of the Judicial Magistrate No.1, Coimbatore, in a case under the Protection of Women from Domestic Violence Act.
Citing various instances, a woman alleged domestic violence against her husband and in-laws. Her son was now studying an engineering course in a college in Coimbatore. The magistrate court passed an interim order directing the student’s father to pay Rs. five lakh towards the educational expenses for admission in the engineering college. The father filed an appeal before the First Additional Sessions Judge, Coimbatore. Aggrieved by that order also, he filed the present revision.

Mr. Justice Manikumar observed that family was one of the most cherished facet of any human being. The father had an obligation to provide love and affection, righteousness, basic amenities and health and education. Protection intended under the Act was exhaustive. He was legally and morally obliged to provide all material needs. A father’s role did not stop when his child attained majority.
The Judge ordered payment of Rs.50,000 to the son on admission having regard to the amount spent towards purchase of books, travel etc. for all these years. He said the monthly maintenance of Rs.5000 should be paid to the wife and not the son. The college should permit the boy to continue his education without any interruption.
